Brief Description
The EU funded Preparatory Action to Support Arab Spring Countries to Implement Asset Recovery (hereafter the ‘PA’) is to support Egypt, Libya and Tunisia in furthering asset recovery cases resulting from the 2011 revolutions that toppled their former leaders, in particular with respect to bilateral judicial cooperation with EU Member States and other countries.
Countries covered: Egypt, Libya and Tunisia.
Objectives
The project is to provide the most up-to-date, worldwide best practices to officials in each of these countries, in both the criminal justice field, as well as in the use of non-penal measures (e.g., non-penal confiscation, use of tax law laws, and reconciliation) as means to capture and recover stolen assets.
Actions in brief
Among other aspects, the project is providing specialized technical advice on:
– Re-drafting of mutual legal assistance requests (to bring them more in line with the needs of Requested States);
– Targeted peer-to-peer missions to EU Member States and other countries with the aim of increasing Egyptian, Libyan and Tunisian expertise on effective modalities for asset recovery;
– Targeted missions of these officials to multiple countries resolve actual pending cases, and coordination with the CARIN network;
– Technical and legal advice to adjust legal and regulatory frameworks to allow for increased use of reconciliation and other non-penal forms for recovery of assets;
– Specialized training for forensic financial analysts, to help them (and to help prosecutors) to better trace suspicious financial transactions; and
– Practical advice on how to create formal Asset Recovery and Asset Management Offices.
